Initial Consultation Agreement

1. Non-Refundable Fees: I understand and agree that fees are non-refundable. This Initial Consultation Agreement is between Regulated Canadian Immigration Consultant (RCIC) Marina Nelson of Marina Immigration Corporation, membership number R533453, located at 2100 Agate Bay Rd, Louis Creek, BC, Canada, V0E 2E0, phone: +1-604-897-9220, email: info@marinaimmigration.com, and the Client.
2. RCIC Credentials: Marina Nelson is a member in good standing of the College of Immigration and Citizenship Consultants (CICC) and is bound by its By-law, Code of Professional Conduct, and Regulations.
3. Consultation Fee: The initial consultation fee must be paid online or by phone and is non-refundable for any reason. This consultation is for assessment and/or advice only and consists of one session, regardless of whether the full time booked is used. This is not an agreement for services or a file review service for applications submitted without our representation.
4. Intended Participants: This consultation is exclusively for myself and my immediate family members. According to Canadian immigration law, "family member" includes a spouse, common-law partner, dependent children under 22 years of age, and dependents of dependent children. Including non-family members requires an additional legal agreement and associated fees.
5. Representation Disclaimer: This initial consultation does not authorize the RCIC to act as my Authorized Representative on any Expression of Interest or Application with any governmental body in Canada. Separate government forms, service agreements, and fees are required for the RCIC to act as my Authorized Representative.
6. Quebec Immigration Act: The RCIC will not represent or advise in connection with a proceeding or application in Quebec, including CAQ/CSQ applications.
7. Credit for Future Services: The initial consultation fee can be used as a credit towards the Immigration case that the RCIC recommends, valid for seven (7) calendar days after the date of consultation. US dollars will be converted to Canadian dollars at the exchange rate published by the Bank of Canada at the time of payment. The client must sign a Retainer Agreement within this period for the credit to remain valid.
8. Governing Law: This agreement is governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Applicable GST/HST will be added to in-Canada orders.
9. Force Majeure: We reserve the right to reschedule a consultation due to circumstances beyond our control, such as natural disasters or power outages, that may result in a temporary loss of internet service.
10. Confidentiality: The Client agrees to the use of electronic communication and storage of confidential information. The RCIC will use its best efforts to maintain a high degree of security for electronic communication and information storage.
11. Limitation of Liability: The RCIC is not responsible for any breaches of information or issues related to online systems or communication.
12. Consultation Scope: We reserve the right to limit the topics discussed during the initial consultation if the questions require excessive research. A retainer agreement may be needed for complex matters.
13. GCMS Notes: By ordering free GCMS notes, you understand and agree that Marina Immigration assumes no responsibility for any delay or the Canadian government's failure to deliver the notes. No credit or substitution will be provided for delays or non-receipt of the notes.
